News Nº 27: Summary of the Zoom Meeting of July 2, 2021

Last Friday we had our Zoom meeting. The meeting was divided into two parts, first in English at 5:30, then in Spanish at 7:00 pm. All questions received were answered at the meeting.

Here is a summary of the questions answered by Covenant. The developer will post the answers to the questions asked of him on PA Today.

Why don’t you accept the colonos card to acess the Resort?

In SAMS they do not receive the Cityclub card … just as in Covenant we do not receive cards from other entities that do not have legal recognition in Puerto Aventuras, therefore these cards have no legal value to prove a property title.

Additionally, these cards present serious security problems. They are very easy to forge and there is no way to deactivate them, which is why anyone who once had that card would have access for life in Puerto Aventuras even if they are no longer an owner, resident or employee, and that is not acceptable.

Therefore, people who do not have the PA Passport must proof that they are owners or tenants through an official document, not with the card without legal value of a civil association that does not have any official function in Puerto Aventuras.

On the other hand, refusing to have a passport or inciting residents to block access to the resort is acting against the community that fully supports the control measures we are taking and that are in force in all resorts in the area, such as, for example: Playacar, Puerto Cancún, Bahía Príncipe …

Furthermore, the reality is that more than 90% of owners, residents and employees already have the PA Passport. Less than 200 people intend to enter daily without the PA Passport, disturbing access to the Resort and endangering everyone’s safety.

Who decides in Covenant?

We function like any civil association in Mexico. All of our members have decided to join our association on a voluntary basis. Every year we have an assembly where the members vote on the important decisions of the association and to elect a President, Treasurer and Secretary, who are in charge of the daily administration of the Association, until the next elections that will take place in December 2021.

Why doesn’t Covenant have accounting, why you doesn’t publish it, or audit it?

Pretending that we do not have accounting or claiming that the former Covenant President had to resign because he did not know where the association’s money was, are part of the many lies spread by people desperate to see their members join our association.

Like every civil association we have accounting and tax obligations. Of course we have an accounting, otherwise we would be in violation of the law. Our accounting for the year 2020 is published on this website since January 15, 2021, anyone can check it.

There is no legal obligation to audit the accounting of a Civil Association in Mexico. Perhaps it is a custom in the United States, but it is not in Mexico. We are professionals and we know how to do an error-free accounting, we do not need to spend our affiliates’ valuable money to pay someone to review the task when we know that we meet all the requirements established by law. On the other hand, our members understand the concept since they themselves do not audit the accounts of their buildings.

 

What is the role of the Developer in Covenant?

The Developer does not have a vote on the Covenant Board of Directors, he only participates as Chairman of the Vigilance Committee to oversee the legality of the decisions made by the Board of Directors. Same role that he held for 20 years in the other association.

 

Why are you discriminating against non-Covenant residents?

As in many associations, we have privileges for our members such as discounts of 50% on the products we offer, and discounts that we have obtained for our members with third parties, such as a 20% discount on water,  discounts at the Beach Club, Golf Club … and the 3 months free we offers at Gignet. Obviously, those who are not members, do not benefit from these privileges and everybody understand that is not a discrimination, since each owner can be a member of our association.

In relation to the entrance to the resort, there is no discrimination either. Any owner can acquire his passport, without being a member of our association, and all owners are treated equally. People who have the PA Passport can enter through the fast lane whatever the association to which they belong, and those who do not have the PA Passport must enter as visitors.

There were several questions about security and theft issues:

To summarize, we have made great progress in controlling who accesses the Resort. In the first semester we have convinced almost 700 employees to have the PA Passport, and now no employee enters without it.

We have also come a long way with the application to control that people who enter the Resort as guests are actually invited by an owner or resident. If you don’t have it yet, we invite you to register: http://colonos.org/en/app/

Now we are insisting that each owner or resident have their PA Passport or proof their status as owner through a cadastral certificate of a property in their name in the Resort.

We also allow access to people who want to go to restaurants. We believe this support is important for restaurants to be profitable and for property owners to benefit from a growing number of dining options, including well-known brands from Playa del Carmen that have opened a branch in Puerto Aventuras.

Once visitors pass the entrance, it is the responsibility of internal security, in charge of colonos, to control that they do not enter residential areas, in which only owners and residents with PA Passport and visitors with QR Codes can enter.

Unfortunately, the internal security does not make that control, therefore, the thefts are their sole responsibility, because they allow people without a PA Passport or QR Code to enter residential areas. We have all noticed that internal security has drastically lowered its budget and abandoned the surveillance of various streets.

We consider that we have done our job correctly by being able to produce the documents and license plates of the people identified as thieves and file a complaint with the authorities, delivering all the evidence and information so that they can do their job.

As you can see, we have worked hard to control the access in Puerto Aventuras as much as possible despite the lack of collaboration from some and the sabotage of others. This work is not over, we continue to implement new things every month. Lately we have equipped our guards with Bodycam, to have a better image of the faces of the people who enter the Resort and also to protect our guards against the mistreatment of some residents and to be able to defend ourselves against people who seek to discredit our work by publishing false news . We are also working on the issue of facial and license plate recognition …

 

Taema:

Covenant has nothing to do with the TAEMA issue, the only association that signed a contract with them was colonos.

Our President has a real estate company in which they have promoted hundreds of projects in the Riviera Maya including TAEMA, but he has never been a partner of that company and several years ago he stopped promoting that project. For which we do not understand, because colonos, who were the ones who signed that contract on November 9, 2016, want to involve us in their mistakes and want to blame us for events that happened before the creation of Covenant.

To be clear, Covenant has never had contact with that company. He has not signed any contract with them and is not interested in any kind of collaboration with TAEMA.

Can there be two schools in Puerto Aventuras?

In Puerto Aventuras, there is a legal school, Colegio Puerto Aventuras that has been operating for more than 20 years and complies with all the requirements of the law, and recently, a new school, located illegally in the residential area, whose neighbors have been complained multiple times. As the Official Association of Puerto Aventuras, we only support the Puerto Aventuras legal school, however, as it is a matter of internal security, it is not our responsibility to handle this matter.

On the Invalidity of the colonos Assembly of 2021.

colonos stated last Friday: “Our lawyer has informed us that the case is still pending the judge’s decision and that the December 2017 Assembly has not been cancelled. There were two decisions in our favor in which the judge found no grounds for cancelation
